Peter D. Mlynek is a patent attorney with over 10 years of experience in various fields of patent law, specializing in patent work related to chemical, pharmaceutical and biotech industries. Peter’s work focuses on preparing and prosecuting patent applications in front of the US Patent Office; managing international patent prosecution; evaluating inventions from business, technology and legal viewpoints; advising clients on patenting strategies; drafting opinions with respect to patent validity, patent infringement, and freedom-to-operate; conducting due diligence on M&A targets; and drafting intellectual property licenses.

Legal Experience

 

Prior to launching his own firm, Peter was a member of the Philadelphia office of a large East Coast general practice law firm, where he prepared opinions and performed due diligence analyses of acquisition targets in small molecules and biopharma businesses for a major pharmaceutical client. He also prepared and prosecuted U.S. patent applications, and directed prosecution of international patent applications. Further, he aided with pharmaceutical litigation by drafting pleadings on behalf of a large pharmaceutical company.

Peter also spend 6 years at a medium-sized intellectual property boutique as a patent agent and later as an associate, where he prepared, and prosecuted U.S. patent applications and directed prosecution of international patent applications; prosecuted and supervised international prosecution of a 240-application global patent portfolio for iloperidone (now Fanapt®); advised business decision-makers in Fortune 500 companies on global patent portfolio strategies; prepared reports on patent landscape prior to client’s entry into new business markets; was the working attorney on a winning patent interference case; and supported trademark opposition proceedings, and patent litigation. Industrial Experience

 

Peter worked for over five years as a Senior Technical Specialist and a Patent Liaison for ICI Polyurethanes and Huntsman Polyurethanes. As a Patent Liaison he interacted with patent counsel and inventors; performed patent portfolio/business strategy formulation; and provided legal opinion and due diligence support. As a product development professional in polymer chemistry, his work included experimental design, directing screening and optimization of polymer formulation, developing new methods, and advising on business strategy.

J.D.: Rutgers University School of Law– Camden.

Ph.D. - Chemistry: University of Wisconsin–Madison. His research work on resulted in 4 academic papers and several posters. He also taught undergraduate chemistry for which he was awarded Citation for Teaching Excellence.

M.B.A. - Finance, Investment and Banking: University of Wisconsin–Madison.

B.S. - Chemistry: University of California–Berkeley. During his school at Berkeley, Peter conducted 4 semesters of independent research in bio-inorganic chemistry, and taught introductory Astronomy.
